A new setback for the municipality of Noordenveld in the development of the new-build area Peize-Zuid, where the construction of 150 homes is planned. Today, the Council of State has decided in a so -called intermediate judgment that the zoning plan must be adjusted.

The construction of the houses on the south side of Peize has been in the pause position for almost three years now. In the summer of 2022, the municipal council of Noordenveld agreed to the development of the new -build area. The zoning plan concerns 20 terraced houses, 45 semi-detached houses and 85 free plots.

Appeal against the construction plans was lodged by four local residents, partly due to the fear of flooding. Eventually the case ended up at the Council of State in November last year, the highest administrative institute in our country.

In February, the Council of State decided that Noordenveld is not allowed to cut trees and Houtsingels in the new -build area for the time being. The municipality also did not get a green light to prepare the location in advance. And today a new damper follows for Noordenveld, because the Council of State wants the municipality to ‘recover shortcomings in the zoning plan’.

According to the Council of State, Noordenveld has failed to conduct further investigation into the consequences for water management in the area. This not only applies to the new -build area, but also to the part where the local residents live. They fear getting wet feet by developments on Peize-Zuid.

In addition, the municipality has not properly motivated why a climate scenario has assumed in which the temperature rises by 1 degree worldwide. According to the Council of State, that should also happen with the heaviest scenario, in which it gets 2 degrees warmer.

The municipality will receive fifty weeks to adjust the zoning plan. “That is long, but that is partly because the assignment is special,” said the Council of State. If the adjustments have been made, the highest administrative court will make a final judgment over the entire zoning plan.
