Fine and community service for fatal industrial accident at VDL Wientjes in Roden

The company VDL Wientjes in Roden has been fined 60,000 euros for an industrial accident, of which 20,000 euros is conditional. The judge finds that the company has violated the Working Conditions Act by having its staff work with a machine where insufficient safety measures had been taken.

The accident happened in January 2020. A 55-year-old operator from the Westerkwartier municipality died after being trapped while converting the vacuum former. A bridging pin blocked the security system, leaving the doors open. The man ended up with his head and torso in the machine and did not survive.

According to the judge, the company failed to provide adequate information and instructions necessary to operate the machine. The employees were insufficiently informed about the risks and dangers. This made it possible – by placing a pen – to work unsafely with a vacuum former. With all its consequences.

The 65-year-old former director from Meerstad was given a community service order of 120 hours for his part. He made the staff work in this dangerous situation. He has been negligent in his leadership and obligation to provide a safe work environment for his employees.

In September, the Public Prosecution Service (OM) demanded a fine of 100,000 euros, of which 20,000 euros is conditional and a community service order of 120 hours.
