The 51-year-old woman from Laren was suspected of dozens of criminal offenses, all committed within the healthcare sector. She had her own care center in Utrecht, where she presented herself as a general practitioner. She has also logged in several times to accounts from (family) doctors to prescribe medicines and referrals to patients. She herself says that there is nothing true of this.

Although the Care Inspectorate (IGJ) came across these abuses – and that is why she had to close her care center – the woman continued to commit criminal offenses. She opened a new healthcare institution, where she submitted false declarations to health insurers dozens of times. With that she possibly earned tons.

‘Pattern of deception’

And it is by no means the only thing the woman was suspected of. The list of suspicions is huge, the judge also sees. “We see a pattern of deception, fraud and abuse of trust. This has not only caused financial damage, but also endangered the health of patients.”

The judge also believes that she was sophisticated within the companies where she was in charge. “She tried to stay out of the shot by means of statutory tricks.” She is guilty of ‘self -enrichment at the expense of others’: “To laws and rules that aim to protect the interests and health of patients, employers, employees, health insurers and others, the woman has no message. The court fails to charge the suspect very much.”

Punishment higher than the requirement

The court’s punishment is higher than the requirement from the Public Prosecution Service. Justice thought that the woman should be sentenced to 20 months, while the judge ruled for 22 months.

The judiciary, however, demanded that the woman had to repay more money to the health insurers: that was about 130,000 euros. From the judge, the woman eventually has to repay more than a ton, because not everything could be proven.

The fact that the prison sentence is nevertheless higher than the claim of justice is partly due to how the woman acted during the two-day lawsuit. “The woman has never taken any responsibility for her actions, but she sees herself as (the only) victim in this case.”

It is not yet known whether Tulay K. will appeal.
