“Dishing, disgusting.” For example, a 37-year-old man from Almere described the abuse of his 3-year-old son by himself. The man made video recordings and sent them to a 17-year-old with whom he had sexual contact during that period. The thirties is a prison sentence of six years above the head and TBS with compulsory treatment.
The mother of the 17-year-old boy got suspicious in July 2023 about the interaction of her son with her ex-brother-in-law, the suspect. The police found the boy at a hotel in Hoogeveen, where the suspect rented a room. The public prosecutor blames the man for the teenager for drugs and had sex with him.
The agents only saw the suspect in the hotel room. The man denied the presence of the boy. The teenager was found in the bushes shortly thereafter, behind the hotel. The boy was not wearing shoes.
The man was only arrested a few weeks later, after he was found again in the presence of the teenager. The boy indicated to the police that he had a sexual relationship with the suspect. This would have started at the age of fifteen, the public prosecutor reasoned.
During the arrest, the phone and computers of the suspect were seized. The police came across shocking images on which a toddler was sexually abused. The child was the son of the suspect.
The messages and the images were carefully presented by the judge. The man constantly moaned how desperate his behavior had been, but denied the child’s rape.
He dismissed a large part of the horrible details that he was held up as a fantasy. Moreover, he could not remember much by drug and alcohol consumption. The man also said to suffer from ‘detention dementia’ (a condition that does not exist according to experts). The suspect was also on trial for fornication with his ex-wife, while she slept. She was unable to defend herself against this. The man had filmed that too.
For the suspect, more than 8,400 images with child pornography were found, partly made by himself. “That does not mean that I managed those files,” the man denied. The man was investigated in the Pieter Baan Center. Due to the behavior of the suspect, no insight has been gained into the “inner world of sir”.
The experts suspect that there is certainly something wrong in the psychological and sexual field, but do not come to advice. The suspect does not show any sense of disease and sees nothing in a treatment. The public prosecutor sees sufficient evidence for the conviction of all five accusations.
“Mr. has seriously damaged the life of three people. Including that of his own son of only 3 years old. The images of this are drastic,” said the prosecutor. The suspect only shown regret to his son at the hearing, she said. “It seems more that he is busy saving his own skin for the rest.” All in all, according to the public prosecutor, the suspect is a danger to society and TBS with coercion, in addition to a long prison sentence, is the only real option.
According to the suspect’s lawyer, the teenager stood on his own two feet after a taxed past. His parents had little to say about him. She asked for acquittal for that part. Regarding the images with the toddler: they do not show what exactly happened, she said. Only fornication, without sexual penetration, can be proven, she thinks. Sexual acts with a sleeping husband is not necessarily punishable, she thinks. “You can find it strange at most.” Filming is punishable, she thinks.
The demanded TBS with compulsory nursing has arrived hard at the suspect. “I estimated that I had to sit for a long time,” he said. He wants to adhere to conditions if they are imposed on him, the thirties promised. A damage claim of 40,500 euros has been submitted. “We can argue about that,” said the lawyer.
The court will rule on 2 September.
