The European Digital Services ACT (DSA) has been in applying since February 2024 to all online marketplaces, social networks, search engines, cloud providers, online travel and accommodation platforms, internet providers and services to share content, such as video platforms. They must better protect user’s fundamental rights, tackle online deception and illegal information and realize a level playing field for users. The Dutch Implementation Act that regulates the national supervision of compliance with this will take effect from 4 February 2025.
After the House of Representatives, the Senate agreed to the bill of Minister Beljaarts (Economic Affairs) to appoint the Consumer & Market Authority (ACM) and the Dutch Data Protection Authority (AP) for this. They can maintain the DSA.
Supervision DSA at both European and national level
The European Commission itself is primarily supervising compliance with the DSA through the 25 largest online platforms and search engines. For example, they must tackle illegal content and disinformation in a targeted manner, adjust their recommendation systems and be transparent about online advertising via their platforms. This includes Amazon, Apple,, ” Google,, ” Meta (Facebook and Instagram),),, X (formerly Twitterand) and Temubut also for the platforms AliExpress,, ” Booking.com and Snapchat. The latter three operate (legally) from the Netherlands in Europe.
In addition to the 25 greatest platforms, for which the strictest rules apply, other digital services must also comply with the DSA. For example, it is forbidden for this category to personalize advertisements on the basis of, for example, religious beliefs or sexual orientation. In addition, minors are extra protected against personalized advertisements. That must contribute to not seeing inappropriate advertising. Among other things, Dutch parties such as Marktplaats.nl,, ” Bol.com and Catawiki must meet these and other requirements within the DSA.
The Member States are responsible for supervising the other digital services. In the Netherlands, the ACM and the AP are the supervisors for this. The ACM has already been designated as the so -called digital service coordinator. Now that the bill has also been adopted, these supervisors can maintain the DSA towards services established in the Netherlands.
The DSA contains different rules about the way in which various online services have to deal with the offer and the users on their platform. If they get a notification that certain content is illegal, they must take action. For example, the ACM is supervising that obligation. Dutch users can also report offenses of online services based online services to the ACM.
