In Argentina it is very common to buy a used car and not be able to transfer. Sometimes the holder does not appear, he does not want to sign or there are pending debts. Meanwhile, the buyer is in a complicated situation: he is not the legal owner of the vehicle, but uses it every day and has no way to prove that he is his.
For these cases, there is a legal solution: the mere holder.
It is an official document that issues the registration of the car and that allows you to legally circulate with the car, even if it is not in your name.
What is it for?
- Circular legally for 12 months (renewable).
- Ensure the vehicle to your name and be able to collect sinister.
- Make technical verification and other procedures.
- Prove that you have a legitimate relationship with the car.
What do you need to process it?
- DNI and constancy of CUIT/CUIL.
- Sale ticket or any document that proves how you acquired the car.
- Police verification (form 12).
- Free debt of patents.
- Two sworn statements: one telling how you obtained the vehicle and another assuming responsibility for its use.
- Complete a digital form 08 (only the buyer signs it, the headline is not necessary).
How is the process?
It is done in the registry where the vehicle is filed. Once the documentation is submitted, the registration notifies the holder to sign the transfer. If you do not answer (which is very likely), but there is a previous sale complaint that coincides with the current buyer, you can advance with a conditional transferwhich becomes definitive after 24 months if there is no opposition.
In summary
The mere holder’s card does not make you an owner, but It allows you to use the car legally until you can regularize it. It is a useful tool, designed for a very common reality in our country.
