Ajax technical director Sven Mislintat has run into problems due to a transfer he recently made. The arrival of Borna Sosa from VfB Stuttgart to Ajax went through a brokerage firm that has shares in a company of which Mislintat owns 35 percent. This is evident from research by the NOS. Ajax said in a response that it was not aware of this and has now discussed the matter with Mislintat. A director at Ajax may not make decisions that involve a conflict of interest with financial consequences. In that case, the Supervisory Board must be involved. The Amsterdam club is investigating the course of events and Mislintat has promised to cooperate fully.

Sports law professor and former Ajax commissioner Marjan Olfers tells NOS that a decision made with conflicting interests can have major consequences for Ajax. “If one or more conflicting directors have not reported a conflict of interest and still participate in the deliberation, that decision is in principle voidable.”

Dennis Vink, professor of corporate finance at Nyenrode Business School, also has major doubts. “Has a transaction been made here at the expense of Ajax for which too much was paid?” asks Professor Vink. “It appears that Ajax has been disadvantaged by this transaction, because the technical director and the agent are both shareholders in the same company.
