On the proposal of Minister Faber of Asylum and Migration, the Council of Ministers agreed to send the House of Representatives of its package of asylum -restricting measures. This concerns the so -called Asylum Measures Act and the Two -Status System Act. This has again taken a step towards the introduction of the strictest asylum policy ever.

The Council of Ministers discussed the advice of the Council of State on the plans. This expresses concerns about uncertainties in implementation. “But I have one certainty,” said Minister Faber: “This is no longer possible. The entire system is stuck, we have to act as quickly as possible. This is what the Dutch want: a fundamental change in the policy to limit the inflow and to promote return. ”

Asylum measures

Minister Faber sent two legislative proposals to the Council of State for advice at the end of last year. The Asylum Measures Act includes, among other things, the abolition of permanent residence permits, limiting the validity of asylum permits up to three years, extension of the undesirable statement, strict conditions for compliance and measures to make asylum procedures more efficient.

This law has been tightened by the minister, when it comes to abolishing the intention procedure. That has a religious effect on the IND, provided that the objection is also abolished. This imperfection has been repaired with a technical adjustment.

The explanatory memorandum of both laws has been supplemented for clarification. This was done on the basis of the further reports drawn up by the minister in response to the advice of the Council of State. Legal sites have also been added, and reference is made to case law. Those additions do not change the content of the laws.

Two -status system

In addition, a so -called two -state system is proposed. The bill makes a distinction between refugees and people who get protection on other grounds. This gives extra possibilities to lower the influx of people in the second group.

A large group of people are currently waiting abroad to come to the Netherlands. This bill will set more conditions for part of this group at the family reunification, such as a waiting period of two years, the disposal and income decision.

Cost

A total of € 115 million is needed to introduce and make the laws enforceable. € 101.8 million is needed for the two -state system, and € 13.3 million for the Asylum Measures Act. The amount is higher than before, because not only the costs for the IND, but also those of the case law, were included. Minister Faber: “This is an investment to save a lot of money in the long term.”

Other measures

Measures have already been taken or announced, such as the introduction of border controls, expansion of the possibilities to set up criminal foreigners – also minors -, an opt -out in future changes in European asylum treaties and termination of the national aliens provision as of January 1.

‘Clear signal’

Minister Faber: ‘All these measures together give a clear signal. This cabinet is racing on the strictest asylum regime and the strictest admission requirements ever. The government expects these measures to contribute to reducing the inflow and also have a positive effect on return. This concerns strangers who are not entitled to stay and foreigners who can go back when the safety situation in their country of origin improves. Due to less intake and more return, pressure on the asylum shelter and the asylum chain, and therefore the pressure on housing, care and education. ‘
