According to the public prosecutor, a 25-year-old man from Emmen was guilty of two attempts to serve serious abuse on the Hoofdstraat in Emmen. A prison sentence of sixteen months, of which ten months are conditional, is demanded against him.
The suspect is said to have shot a person from close by at the end of August and the beginning of September and hit another to the ground. “An unguided projectile,” the public prosecutor called this suspect. Out of the blue the victims on the street were attacked by a stranger. She called this ‘worrying’.
The Emmenaar only confesses the fists at the end of August at a grill room on the Hoofdstraat in Emmen. The images of this were shown during the court session. A group of men can be seen on this, engaged in a fierce discussion. The suspect, recognizable on the screen, walks through it and gives one of the arguing men a punch on the back of the head.
The suspect then gave the victim a fist in the face and a staircase while the man lay on the floor during his fall. Others dived on top of the victim, while the suspect walked on. The suspect recognized himself in the images. He said he had to hit the man because he pulled a weapon. He wanted to protect his brother against it.
The judge asked questions about this reasoning. Only the suspect stated about a weapon at the victim. The images do not show that a weapon was drawn. The victim has remained unknown to this day. According to the public prosecutor, that does not alter the fact that the Emmenaar, by beating and admitting that he wanted to knock the man, was guilty of attempting serious abuse.
Two weeks later, according to the prosecutor, things went wrong again on the Hoofdstraat in Emmen. A cyclist scamped a car and visited the owner to arrange the damage. A visitor to a grill room joined the conversation. Without any reason, the man pulled a weapon and shot up close to the cyclist’s head.
The victim fell to the floor and was hit again on his neck, chest and back. The shooter ran away. Bystanders gave an accurate description of the man. A woman came with the name of the suspect. She knew him as an ex-boyfriend of hers. The public prosecutor attaches great importance to the statement of the woman. The suspect denies. He never said he had had a weapon.
The weapon was never found. The victim had bruises on his chest and back. Two weeks after the incident he was picked a piece of metal from his scalp with tweezers. It was invisible and deep in the skin. It has not become clear what exactly was shot. Attempted manslaughter cannot be proven in this case, says the public prosecutor. Attempt at severe abuse.
The Emmenaar was previously convicted by the juvenile judge for open violence and attempt at a robbery. According to the public prosecutor, he does not repent. He denies or puts the debt outside himself. The man has been in custody for 49 days and wears an ankle band. A prison sentence equal to the custody finds the prosecutor in skinny.
