The Court of Appeal in Leeuwarden rejected the then girlfriend of Carlo Heuvelman a compensation of 218,057 euros, which had to be paid by five suspects. But whether she will ever get this money is now unclear.
The suspects did not agree with the compensation and according to their lawyer Anis Boumanjal ‘the legal basis is missing’ for the award.
So at the Supreme Court they went against the compensation in cassation. He announces today that the Court of Appeal should again see if this claim for damages is properly substantiated. The Supreme Court doubts whether the suspects have had a sufficient chance of defending themselves against the claim. When the court will look at this again is still unclear.
No grief for the parents
But with the girlfriend of the deceased Carlo it is not alone. The Supreme Court also stipulates that the parents are not entitled to grief money.
According to the judge, grief money is personal and it is only intended to mitigate the suffering of the victim himself. Because Carlo was in a coma after his abuse, he could not experience that suffering and both he and his parents cannot be eligible for grief money.
Death of Carlo after nightlife violence Mallorca
Carlo Heuvelman died in July 2021 due to extreme nightlife violence on Mallorca. Several boys from Hilversum were suspected of manslaughter, including main suspect Sanil B. He would have kicked on Carlo, together with two or three others, while he was already on the ground. The Hilversummers have always been silent about who was guilty of the fatal abuse, and there were no camera images.
The Court of Appeal ruled in March last year That there was insufficient evidence to condemn one of the boys for the manslaughter on Carlo. According to the Court, the witness statements were too unclear and influenced. A DNA trail from Carlo was found on the shoe of main suspect Sanil B., but that was so small that it could not be directly linked to the violence against Carlo.
Sanil B. received a 32 -month prison sentence on appeal, three of which were conditional, for attempted manslaughter of two other people and for open violence. At the time of the ruling, he was already largely in custody at the time of the ruling.
Suspects Mees T. and Hein B. received 14 and 15 months in prison for open violence. Kaan B. and Daan van S. were given 11 months, of which 83 days were conditional. Lukas O. was sentenced to 18 days in prison and a 240 -hour community service, and Stan F. received a community service sentence of 110 hours.
