According to a preliminary ruling by the Bavarian Administrative Court (VGH), the Bavarian state government no longer wants to apply the 2G rule in retail. "In Bavaria, we are completely suspending 2G in retail and thus ensuring that the VGH decision is implemented quickly and practicably", said Head of the State Chancellery Florian Herrmann (CSU) immediately after the decision became known on Wednesday.
With the access restriction to those who have recovered and those who have been vaccinated (2G) in retail, Bavaria has followed a decision by the Prime Ministers’ Conference, "but because of the difficulties in delimitation that have arisen, the regulation as in the supermarkets is now the simpler alternative". Herrmann also emphasized: "The FFP2 mask requirement in retail continues to apply and offers protection."
The Bavarian Administrative Court had granted an urgent application from the owner of a lamp shop in Upper Bavaria and temporarily suspended the 2G rule. The reason given by the court was that the Infection Protection Measures Ordinance with its non-exhaustive list does not make it clear enough which shops to cover daily needs are exempt from the 2G regulation and which are not.
