Báez Sosa: what will happen after the sentence

Today the sentence will be known to the rugbiers accused of the murder of Fernando Baez Sosa. And although the court must issue its decision, after three weeks of hearings, it is not the end of the case: both the prosecution and the defense will have seven days to present the appeal in the Court of Cassation of the Buenos Aires province, which does not have deadlines to rule on the subject, since despite the fact that the law establishes the need for as many lovers as possible to be issued on the case, Cassation could take a period of more than two years to pronounce a sentence, due to the large number of files they must review. In case of not complying with the stipulated term, they will not be able to appeal the sentence.

Once the sentence is known, the defendants will be taken to a maximum security prison, where it will be difficult for them to have the benefits of remaining united and isolated from the rest of the prisoners. In these conditions it is where they must wait for the resolution of Cassation, in case there are appeals. And later will be the instances of the provincial and national Supreme Court.

Due to the commotion that the case has generated in Argentine society and, particularly, in Dolores, the security of the place became a concern for the Court. To such an extent that during the allegations the staff of Police and the one of Buenos Aires Penitentiary Servicein charge of the transfer of the accused from the Warden of Unit 6 to the Courts: a distance of only 10 blocks. The entire block that includes the main access to the courts was also blocked.

The accusing party (the attorney for the Báez Sosa family, Fernando Burlando; and the prosecutors gustavo garcia and Juan Martin Davila), requested that the crime be classified as aggravated homicide due to treachery and the premeditated cooperation of two or more people, and requested that the sentence be life imprisonment. In contrast, the rugby players’ lawyer, Hugo Tomei, considers that it was a homicide in a fight, or preterintentional homicide or eventual intent. Requests the acquittal of the accused or a sentence ranging from 1 to 6 years: taking into account that the accused have been in prison for three years, in this case they could be released after 3 more years have elapsed.
