The NADA wants to wait for a European solution before it gives the name of doping fitters. A procedure has already been initiated.
The National Anti Doping Agency (NADA) has for the past financial year “Overall solid conclusion” pulled. In the event year 2024 with the European Football Championship in Germany and the Summer Olympics in Paris, there were 93 possible violations of anti-doping regulations, as the NADA announced on Tuesday (June 3rd, 2025) at its annual press conference in Berlin.
This number emerged from 12,100 checks with 16,386 samples, and there were sanctions 20 times, while 16 criminal charges were issued under the anti-doping law. In 17 cases there was no doping violation, 44 athletes or athletes had a medical exception (TUE), twelve proceedings had not yet been completed at the time of going to press. There were also 300 reporting and control failures.
Procedure at the European Court of Justice
In the debate about the publication of sanctions decisions, the NADA hopes for a solution by the end of the year. Among other things, she put hope in a procedure initiated from Austria that is pending at the European Court of Justice, said CEO Lars Mortsiefer.
“There is only a harmonized solution if it is uniform in Europe. We are in good spirits that everything comes on the table and that legal proceedings crystallize – and then go to the member states from Europe”, ” said Lars Mortsiefer: “We are still convinced that we can only get such a uniformity. Accordingly, we hope that we have clarity at the end of the year.”
ARD research cause a sensation
At the end of May, research by the ARD doping editorial team caused a stir, according to which the NADA, out of concern about legal consequences since March 2020 on its own drive, had no longer published sanction decisions against doping offenders. The NADA subsequently justified its approach with “the applicable law in data protection.”
After that, there was criticism of athletes and politics. Mortsiefe emphasized the dissatisfaction of the Nada on Tuesday with the status quo and the will to change. “It is important that we see: where do we stand? And what can we change very quickly? To trigger a hello wax effect again, it was very important. Because these procedures have been taking us too long. We also want to have legal clarity”, ” he said.
Other legal situation in Austria
In Austria, an anti-Doping Federal Act obliges the Austrian anti-doping legal commission, especially about decisions in anti-doping procedures.
“This is a philosophy question. said Mortsiefer. The ongoing ECJ procedure deals with that practice, in which the focus is on data protection admissibility of such publications.
