The municipality of Assen must re -assess whether it is necessary to force an entrepreneur to shorten his garage. That is what the Council of State thinks. The entrepreneur from Assen must demolish one meter from his garage on the Nijverheidsweg.

This is apparent from a final judgment of the highest administrative court in a conflict between the entrepreneur, the municipality and a neighbor. It is a matter that has been playing for a while. The entrepreneur, who has a material and machine rental company, built a garage next to his company and company home.

His neighbor, who is also a garage owner, doesn’t like that and believes that the entrepreneur must demolish the garage in his whole.

The municipality then imposed a penalty omo of 2,500 euros on the entrepreneur. But a judge put another line through it. Then the Council of State looked at the issue. He now definitely notes that the garage is largely legally on the backyard site. All except for one meter. But that is just the front with an expensive roller door.

To make a long story short, the highest administrative court dedicates to the municipality of Assen to re -view or to force the entrepreneur to demolish a meter from his garage, or to legalize it in a different way.

The entrepreneur said he wanted to arrange with the municipality and his neighbor earlier. “I would like to come out in consultation, but the alderman from Assen said that I have to finish the building conflict with my neighbor, but he doesn’t want to talk,” said the entrepreneur during the Council of State last December.
