Nicol Kremers (34) is not allowed to ask her ex Peter Gillis (62) questions about their relationship and alleged abuse under oath. The court in Den Bosch ruled on Monday. Nicol wanted to use that interrogation to get rid of a divorce agreement, in which she promised to bring nothing about Peter Gillis. But the court sees no need for an interrogation from Gillis.
According to Nicol, she was mentally and physically abused and that agreement was signed under forced. With the interrogation under Ede she wanted to achieve that Gillis admits that. At the end of 2023, during a lawsuit in Utrecht, it appeared about the publication of a book about Gillis that it already demands 1.7 million euros from Kremers, because they would have violated the rules of the agreement.
And that is why Nicol Kremers is now trying to end up with that confidentiality clause. According to her, she suffered badly from the abuse and she signed that agreement under pressure. She was scared and wanted to leave Gillis as quickly as possible.
Nicol lived in Gillis’ house and was then completely dependent on him. The man who drafted the agreement was the legal adviser. “A vassal by Gillis,” said Nicol’s lawyer. “And he paid him too. And then it is whose bread one eats, whose word one speaks. “
Psychiatrist
Nicol Kremers also wanted to hear a girlfriend about how hard she was in that period and a psychiatrist had to explain to the court what abuse by a partner can have an effect on someone. But the court finds that she has already taken a position in the current proceedings and does not add witness hearing. Furthermore, she insufficiently substantiated why she still has an interest in hearing witnesses at this stage of the soil procedure.
In addition, the court in the other case has already determined the demanded fine that there will be an oral hearing. The case is at an advanced stage and now that a witness hearing is being ordered, that can only delay the course of events. According to the court, that is not efficient, also because the results will not all be equally relevant to the soil procedure about the fine.
The court expects that after the oral treatment in the soil procedure there will be an (interim) judgment. In it the court can indicate whether Nicol Kremers should come up with extra evidence and, if so, what that should look like.
