KARLSRUHE/RANGSDORF (dpa-AFX) – On Friday (9:00 a.m.) the Federal Court of Justice (BGH) will deal with the question of whether a family from Brandenburg has to tear down their house and vacate the property after an official error. She purchased the property at a foreclosure auction in 2010 and built her house on it. However, the award was later revoked because, in the opinion of the Potsdam Regional Court, the responsible authority had not sufficiently searched for the original owner.

The owner demanded the almost 1,000 square meter property back in court. The Brandenburg Higher Regional Court largely upheld his lawsuit in 2023 and ruled that the family had to demolish the house and vacate the property within a year. In addition, she should delete a mortgage of 280,000 euros plus interest for the construction costs and pay the owner 6,000 euros for the use of the property.

The affected couple appealed against the verdict, so that the case ended up at the highest German civil court. The deadline for evacuation and demolition was initially extended. It is unclear whether a verdict will be made on Friday. (Af. V ZR 153/23)/jml/wpi/DP/zb
