The ruling that benefited Montiel
The case that the footballer was facing came to an end two weeks ago, when the Judge of Criminal Guarantees No. 5, Gustavo Banco, resolved dismiss it due to lack of evidence. According to the magistrate, the reported sexual abuse “did not exist.” The ruling was based on the analysis of evidence and testimony that were key to determining that the facts did not have sufficient support.

Montiel’s defense after the ruling

The initial complaint
The case dates back to March 2023, when a woman, Carolina B.represented by Hermida, accused Montiel of sexual abuse. According to the complainant, the events occurred during the footballer’s birthday party in January 2019. The woman stated that, after consuming drinks at the event, she began to feel ill and lost consciousness, subsequently waking up at the entrance to the man’s house. Montiel “wet and full of mud.”
According to her testimony, the player’s mother would have contacted her to say: “They raped you, mommy.” However, the investigation concluded that these facts could not be proven and that the accusation was unfounded. As it transpired Montiel decided not to sue the complaining woman since the defender of the National Team and his lawyers understand that it was used by the lawyer Hermida, supposedly “for extortion and economic purposes.”
