Erba massacre new elements: review of the trial from 1 March 2024

A new “multidisciplinary consultancy” could explain what is behind the retraction of Olindo Romano and Rosa Angela Bazzi

After 17 years, the case of Erba massacre return to the classroom. The Court of Appeal of Brescia has ordered the process review for Olindo Romano and Rosa Angela Bazzi, definitively sentenced to life imprisonment for the murder of Raffaella Castagna, her son Youssef Marzouk, Paola Galli and Valeria Cherubini, which occurred onDecember 11, 2006. Tomorrow, March 1st, there will be the first hearing. A new judicial chapter that reopens the pages of a tragedy that shocked Italy and which, right from the start, provoked a heated public debate. Olindo and Rosa, neighbors of the victims, were identified as responsible for the deaths at the end of an intense and controversial investigation. Their confessionsmade immediately after the arrests, were then retracted during the trials, in which both have always proclaimed their innocence. Despite the numerous requests for review presented by the lawyers of the two spouses, however, only the last one was accepted by the Court of Appeal of Brescia.

In an unreleased video aired at Fourth Degree last Friday, Olindo Romano talks about the motive for the Erba massacre. “That was the one that broke the camel’s back,” the man says. “Because we are different humiliation of going to court when we were right we didn’t want to do it. And we took her out first. Now I don’t care what happens, if they give me thirty years, I don’t care. I ask either to stay with my wife or otherwise nothing.” For Olindo Romano and his wife there were two possible solutions to resolve the issue: “You called his father, at two, three, four in the morning, to come up to see, to hear what her daughter was doing and he didn’t care” he explains. “At this point we only had two things left to do: either sell the house and leave or take it out. Since selling the house and moving out was the fourth time we had moved, why did we have to move out? And that’s all for not having insulated the floor because when you bought the apartment you moved all the rooms. If she left the room on our room as the architect had placed it, nothing would have happened. Not her, she stayed there. By staying there you know… if one goes to sleep early, because I got up early in the morning, but she was up until one or two in the morning making a mess.”

And on the other condominiums: “Practically all those in the courtyard there who speak well of Castagna is because they are on his father’s payroll. Including the Carabinieri, keep watch. Mayor, there’s no talking about it. Because if I complain about a person who makes noise and they stop, then they end up there, right? But if I complain about a person who makes noise and this person makes it more and more and I don’t say anything, it’s because either I’m fine with hearing noise or I have an advantage. She was making noise because he did it on purposebecause he knew it bothered us.”

The defense team will propose to listen to the experts on the blood trace found in the spouses’ car and advice to assess the suitability of Mario Frigerio – the only survivor of the Erba massacre – as a witness, considering his brain damage. The dynamics of Valeria Cherubini’s death will be the subject of a neurological consultationwhile the criminologist Roberta Bruzzone will reconstruct the dynamics of the attack. Furthermore, the psychopathological picture of Olindo Romano and Rosa Bazzi, together with the latter’s mental retardation, in relation to their confessions. The psychiatric report on Olindo will also be relevant. The defenders suggest one inconsistent description of Frigerio and will present the trail of a settling of scores linked to drugs and money, supported by the testimony of Abdi Kais, the alleged super-witness never heard by the investigators. Finally, a “new test” is proposed, as reported by Daily factwhich attributes the spouses’ confessions to cognitive and psychological disorders, underlining the need for a review of the case. Important elements that had not been evaluated in any of the previous processes and which will now find ample space thanks to “multidisciplinary consultancy”.

the accusatory system

The telephone interceptions, the confessions of the spouses, the discovery of traces of DNA in the couple’s Seat Arosa and the testimony of Mario Frigerio constitute the pillars of the accusation; all elements already recognized as evidence by the Court of Assizes. The interceptions also reveal a suspicious dialogue between spouses, who seem to anticipate being under observation. Furthermore, the spouses’ confessions regarding the dynamics of the murders and the attack on Frigerio provide specific and detailed information which were not known to investigators. The presence of Cherubini blood on various places, including the door sill of the car, also provides further incriminating evidence. Finally, notes found on a Bible and a letter sent to a priest seem to point to a certain guilt and resentment by the spouses, which strengthens the prosecution’s case.

At this point, the procedural phase can reach three different conclusions: the acquittal of Rosa and Olindoa reconfirmation of the sentence or the acceptance of the inadmissibility of the request for review.
