In Germany, dealing with cannabis is defined in the Narcotics Act (BtMG). In this hemp is classified as “not marketable”. Thus, any possession of cannabis and cannabis products (hashish, marijuana) is illegal and therefore punishable.

According to Section 29 et seq. of the BtMG, anyone who: “illicitly cultivates, manufactures, trades in narcotics, imports, exports, sells, hands them over without trading, or otherwise puts them into circulation is punishable by imprisonment or a fine brings, acquires or procures in any other way.”

The consumption of an illegal drug is not punishable in Germany. However, since consumption usually precedes possession, people who smoke weed are usually liable to prosecution.
