Late in the evening, the Sports Guarantee Board at CONI made it known that it is not within its competence to verify the alleged ineligibility of Giovanni Malagò for the presidency of the Football Federation, whose elective assembly is set for June 22nd. He declared this in a statement that responds to the request for a formal opinion, requested four days ago by the Minister for Sport and Youth, Andrea Abodi, following a parliamentary question in relation to the application of the rules on the so-called pantoufflage in the top positions of the sports system. The minister also made a similar request to the National Anti-Corruption Authority (Anac).

“A ruling concerning this preliminary verification would appear to go beyond the competence of the Board – we read in the ruling, relating in particular to art. 3 of the FIGC’s Federal Internal Organizational Rules (Noif) -, also on the basis of the consideration that the Board itself could be called upon to rule in final instance on the measures for admission and/or denial of candidatures in the event of an appeal”. Furthermore, the Board noted that “if, on the one hand, the possession of the relevant requirements for the purposes of the sports regulation provided for in art. 29 of the FIGC Statute, approved by the National Board of the CONI is not in question in the case in question and in relation to the electoral procedure, on the other hand, the evaluation of any other profiles of candidacy and/or eligibility, which do not fall within the latter, would end up falling outside the competence of this Board, possibly falling within the functional competence of the national Authority anti-corruption”.

It is therefore up to Anac to decide. Abodi hopes that the opinion will arrive by 22 June (“Respect is absolute, the Authority will evaluate the timing because it is a topic that deserves in-depth analysis. And in-depth analysis presupposes time. Anac knows perfectly well what the appointment is”), while the president of Coni, Luciano Buonfiglio, observes: “I am convinced that the opinion will not arrive. Anac does not carry out an investigation in such a short time. What if I fear an appeal after the FIGC election? I know, I would have preferred everything to be simpler and I’m sorry it has come to this situation.”
