The internal Justicialist Party in Tiger It stopped being a partisan procedure and became a court case with a strong political impact. The federal judge with electoral jurisdiction Alejo Ramos Padilla revoked the decision of the Electoral Board of the Buenos Aires PJ that had excluded the list headed by the mayor Mario Alberto Zamora and ordered its immediate officialization. Furthermore, it annulled the proclamation of the single list of Emilio Samyn Ducó. Result: there will be interns on March 15.

The controversy began when the Resolution No. 10 of the Board decided not to make Zamora’s list official because it considered that the list of congressmen had been completed after the deadline. The argument was technical: candidates would have joined once the deadline had expired. Under the principle of estoppelthe list had to be left out.

The court ruling dismantles that interpretation. According to the judge, there was no incorporation of new applicants but a simple internal runoff of candidates already presented in a timely manner. The text maintains that “It was not about the incorporation of new candidates outside the stipulated period, but rather about the formal adaptation of a list already previously presented”. And adds a central criterion: “It is not within the law to deprive a list presented on time of its electoral participation due to formal defects”.

The resolution also points to inconsistencies in the internal communication of the Board itself regarding the number of positions to be elected. The published forms indicated twelve starters, while the call required fifteen. That ambiguity was considered relevant to evaluating the reasonableness of the rejection.

The ruling cites jurisprudence of the National Electoral Chamberwhich establishes that the principle of participation and internal pluralism. The doctrine is clear: when faced with two possible solutions, the one that guarantees greater competition and not the one that restricts it must be chosen.

Consequently, the ruling declares the resource timingrevokes the Resolution No. 46 which had dismissed the appeal and ordered the immediate officialization from the list of congressmen and advisors headed by Zamora. It also annuls the advance proclamation of Samyn Ducó’s single list and requires guaranteeing equality of conditions, number and color of the list.

The political background is not minor. Zamoramayor with his own territorial weight, had been misaligned with the massista army within the provincial PJ. The exclusion from his list was interpreted by those around him as an attempt at internal discipline. The court ruling, however, reopens competition and forces the leadership to be settled at the polls.

In a district historically linked to massism, the decision has resonance beyond the procedural. The message is forceful: the regulation cannot be transformed into a tool of political exclusion. Tiger will vote. And it will do so by decision of the Electoral Justicewho recalled that internal democracy is not recited, it is guaranteed.
