Wiz Khalifa was sentenced to prison after consuming cannabis at the “Beach, Please!” festival. Is he at risk of extradition from the USA? The legal situation.

US rapper Wiz Khalifa has been convicted of drug possession in Romania. The background is an incident from the summer of 2024 in which the musician performed during a performance at the Romanian music festival “Beach, Please!” is said to have consumed cannabis on stage in Constanța County. The Romanian police stopped Khalifa after the concert in July last year after receiving tips.

According to the public prosecutor’s office, more than 18 grams of cannabis were seized from the artist, whose real name is Cameron Jibril Thomaz. Some of it is said to have been smoked during the performance. The investigation led to a charge of unlawful possession of drugs for personal use. The Romanian news agency Agerpres reported that Khalifa was initially only sentenced to a fine of 3,600 lei (around $830).

Appeal leads to stricter sentence

However, this judgment did not stand. Prosecutors appealed and asked for a harsher sanction. As a result, a prison sentence of up to one year was imposed. Since Wiz Khalifa had already left Romania and is residing in the United States, the question now arises as to whether he is actually at risk of imprisonment – and whether Romania could request his extradition.

Imprisonment sentence according to Romanian drug law

The legal basis for the procedure is Romanian Law No. 143/2000 on combating illegal drug use, in particular Article 4 Paragraph 1. This criminalizes the possession of drugs for personal consumption and provides for a prison sentence of three months to a maximum of two years or a fine. Cannabis is considered a so-called “risk drug”, but not a high-risk drug. In Romanian practice, fines or probation decisions are often imposed for small quantities and no intention to trade.

Is extradition realistic?

The legal situation regarding extraditions from the USA to Romania was stipulated for the first time in 2003 in the “Agreement between the European Union and the United States of America on extraditions”. In Article 4, this only provides for the transfer of delinquents under strict conditions, for example in the case of serious crimes and double criminality. Since the possession of around 18 grams of cannabis is legal or only slightly sanctioned in many US states, an extradition request is considered difficult to enforce legally and politically. Despite the verdict, Wiz Khalifa’s actual imprisonment in Romania is therefore extremely unlikely.

New album and cannabis brand
