People who receive compensation due to errors in their disability benefits retain their allowances and other income-related arrangements. The Ministry of Social Affairs and Employment has drawn up a scheme that makes it possible to receive a one-off financial compensation without this having negative effects on income-related schemes, such as healthcare or housing allowance. This scheme is going into internet consultation today. People can give their opinion on this topic until January 16, 2026. The first compensation is expected to be paid in the course of 2026.
Surcharge solution
The compensation that people receive does not count towards their taxable income. UWV pays the payroll tax directly to the Tax Authorities. This means that the victims can keep the entire amount and the income on the basis of which their benefits are calculated does not increase. Their housing allowance, healthcare allowance and other income-related allowances therefore remain as high as normal.
Process
Once the internet consultation has been completed, the Ministry of Social Affairs and Employment will incorporate the results into a new version of the scheme. Once the new version has been completed, the regulation will be signed by the Minister of Social Affairs and Employment. The UWV can then start implementing the scheme.
