A 41-year-old man from Liempde takes the prison for six years and nine months for the rape of his ex-girlfriend. He also receives TBS with compulsory treatment. The court in Den Bosch determined this on Friday. The man raped his ex-girlfriend in Boxtel in March 2021 and robbed her freedom. According to the Court, he humiliated the woman by raping her in her own house in perverse and brutal.
At the end of 2021, the court sentenced him to three years and TBS with compulsory treatment. So much less than what has been imposed on him now. He had appealed himself. His lawyer even advocated acquittal.
‘Sick cat was an excuse’
The Court states that the man had a preconceived plan to be able to hit that day in March 2021. He managed to tell his former girlfriend that her cat was not doing well. The animal was in a shed. The man waited for the woman, grabbed her and dragged her into her home. Then he locked the back door and the woman was forced to walk to the Zolder. He raped her there.
According to the Court there was involuntary sex. The woman refused to undress and she made it clear to the man that she didn’t feel like having sex with him. She was done with him. However, he was not with her. The woman was raped in a violent way and suffered injuries that were ‘not normal’ according to research.
Hof takes it up for ex
The man played the murdered innocence during the court case. He continued to deny everything and told how heavy he had it through the declarations of his ex. The Court had great difficulty with his attitude: “It is not the suspect who happened to ‘something’, but it is the victim that this was done by him.”
The woman is still suffering from it, it turned out when she used the right to speak. The court heard seriously adverse psychological consequences: think of enormous anxiety, concentration problems and stress. She is therefore entitled to compensation, the amount of this was set at more than 15,000 euros.
Nine months of penalty discount
The Public Prosecution Service had demanded five years at both the court and the court. The court therefore imposes the man for six years and nine months. He had actually ‘earned’ seven and a half years in prison. In the consideration of this, the Court of Appeal took into account that the man has been convicted of domestic violence and rape several times. Because the appeal procedure lasted too long, the man received nine months of penalty discounts.
The Public Prosecution Service, the court and the Court of Appeal were aligned about the TBS with compulsory treatment. The man should not only sit out a long prison sentence: intensive treatment is needed because he has various disorders and is addicted to cocaine. The man is furthermore feminine, little empathetic and has narcissistic traits. He is little interest in fellow human beings. Researchers have established that there is a high chance of repeating a sexual offense.
