A judge is said to have turned a TV documentary about the case without permission. She resigns after commitment to bias. That has followed.
The criminal trial against the medical team of the Argentine football legend Diego Maradona has burst. Because a judge of the three -member chamber has withdrawn from the case after the applications for bias, the procedure must now be re -rolled up. The previous two remaining judges declared the previous process to be void, reported the television station TN.
Previously, judge Julieta Makintach had been suspended from duty for 90 days for her work on an unauthorized documentary. Most recently, it became known that the lawyer had made a TV documentary about the process without the approval and knowledge of her colleagues. A trailer and the draft for a first episode of the documentary appeared in local media. The lawyers of the accused, the co -plaintiff and the public prosecutor then accused the judge of biasing what she retired from the procedure.
“Judge Makintach did not act impartially. Both the public prosecutor’s office and defense harmed her behavior,” the newspaper “La Nación” quoted the judge Maximiliano Savarino.
Now a new criminal chamber has to be ordered. All evidence and testimonies from the 21 days of negotiations so far must be presented again. “I wish everyone the best of luck and that justice that they earn,” said judge Verónica di Tommaso.
His clients are very disappointed, said lawyer Fernando Burlando, who represents Maradona’s daughter Dalma and Gianinna. According to media reports, they broke out in tears when the decision was announced. “To clean up the mistakes, three new judges have to order and a new negotiation should be set as soon as possible,” said Burlando.
Since March, seven doctors and nurses from Maradona have been on the court in San Isidro north of Buenos Aires. The public prosecutor accuses Maradona’s personal physician Leopoldo Luque, his psychiatrist Agustina Cosachov and an other doctor, the medical coordinator of health insurance and two nurses homicide. All accused reject the allegations. In the event of a conviction, they face imprisonment of up to 25 years.
Maradona died of a heart attack on November 25, 2020 in a private residential complex at the age of 60. A few weeks earlier, he had undergone brain surgery. According to the investigators, massive mistakes were made in the home care of the world champion in 1986, which was difficult to health.
