The fines that stand on not fulfilling the so -called obligation to provide information for beneficiaries are adjusted. This is stated in a amendment decision that Minister Eddy Van Hijum (Social Affairs and Employment) is opening today for internet consultation.

Someone who receives a benefit has an obligation to provide information. This means that persons must pass on changes in their situation that may be important for the right to the benefit. For example, if someone with social assistance benefits (partially) starts working again, gets an inheritance or starts living together.

Realistic fines

People who do not pass on changes properly and therefore wrongly receive too much money, must pay back and can also be fined. Minister Van Hijum is currently unrealistically high for people on benefits. It also often happens in practice that the fines imposed are not collected. The internet consultation on the adjustment of the fines decision in social security therefore states, among other things, that these fines are reduced. This so that the fines become more realistic and reasonable.

The internet consultation also states that imposed fines must be able to be paid within a ‘reasonable period’. Fines for violations must be able to be paid within 12 months, fines for serious violations within 24 months. If it becomes clear that someone cannot pay the fine to be imposed within this period, the amount will be lowered.

Measures Decree

In addition to an adjustment of the fine decision, an adjustment of the Measures Decree is also opened for internet consultation. This concerns two limited legal changes.
