Subhi Al H. from Helmond is not released for the time being. The court in Den Bosch imposed him for 2.5 years in prison and TBS with compulsory treatment. The man was already in custody after he was arrested after a neighborly fight, in June 2023. His then 60-year-old down neighbor Jacqueliena escaped death when the man at least five times on her stabbing. Her attacker has to pay compensation of more than 14,000 euros.

According to the judge, the 34-year-old H. has been guilty of attempted manslaughter and abuse. When Jacqueliena was sunbathing that summer day in the garden of her house on Trompstraat in Helmond, she was hit by an ashtray and a glass ball without any reason. The woman suffered injuries on her head and shoulder. The culprit? That was her Syrian neighbor, who has been living in our country for almost eight years. He pelted her from his balcony.

Shocked, the woman ran inside. In the kitchen, according to the judge, she was met by Al H., who stabbed her several times. Jacqueliena thought it was staying with this, but a little later the neighbor came back and her knife stitches were again inflicted. Only then H. thought it was enough. He left his neighbor helpless, seriously injured and in a puddle of blood. During the session, two weeks ago, he swore that someone else had stabbed Jacqueliena.

Quarrel
According to the woman, they had a fight for some time, especially about the noise that her neighbor would cause. “He played Arabic music in the middle of the night, used my garden as an ashtray and he pisted from his balcony in my garden,” Jacqueliena told Omroep Brabant earlier. The local police officer and the housing association knew that the two were upset, but they probably also had no idea that things would get out of hand.

In the ruling, the judge emphasizes that the victim has out of death and that still in her own house. It was due to a witness and a neighbor who quickly received help and that she survived the attempted manslaughter, the judge’s judgment was. Jacqueliena still suffers: every day she gets up and goes to bed with pain. She also moved because the home she had been abused by her neighbor reminded her of that brutal attack.

Partly not to be charged
The judge also took into account in the ruling that H. has previously been in contact with the police and the judiciary for committing violence. And that he has already been detained for this. It was also taken into account that the Syrian was schizophrenic when he was unable to restrain himself that day in June. His disturbed behavior was therefore partly impossible for him.

Al H. and his lawyer opposed the TBS demanded during the hearing. They wanted acquittal, because already H. denies, but if he would be convicted, than without TBS with coercion and rather care in a different way. The court has decided otherwise.
