The US President thus reverses part of the so-called Title IX Act. This law on equal participation in educational offers has existed since the 1970s. Among other things, Trump’s predecessor Joe Biden supplemented the participation of transpersons in school and colleges sport.

With his current decree, the US President continues his announced policy, defined the gender exclusively as male and female and restricts the rights of transpers.

Schools that allow transmens allow access to changing rooms could threaten punishments

His decree means that trans women in women’s sports in high school and college are not allowed to participate, because: If schools allow trans people access to changing rooms that do not match their birth -sex, these schools should be sanctioned.

Trans people are people who have been assigned a gender at birth that does not correspond to their identity. How many trans-athletes there are in the United States that are affected by these requirements is unclear.

Trump already agreed in the election campaign against transgender

US President Trump’s argument is that “women’s sports should only be for women”. Already in the election campaign, Trump had often spoke of the “transgender madness” and attacked his rival Kamala Harris for the support of the LGBTQ community. After taking office on January 20, he issued a number of decrees with which he weakened the rights of the community.

The human rights organization Amnesty International criticized the decree as “another cruel attack on transgender people”. Civil rights lawyers argue that Trump’s executive orders violate laws adopted by the congress in some cases and the protection of the constitution – and that in their opinion, they exceed the president’s powers.

Sport is still looking for a solution

The National Collegiate Athletic Association (NCAA), which is responsible for organizing the sports competitions of many colleges and universities in the USA, welcomed the arrangement as a clear, national standard, which replaces the “patchwork” from “contradictory state laws and court decisions”. She wanted to implement the decree “in the coming days”

The international sports world is still looking for a fair solution with regard to the participation of trans women in women’s competitions. The world associations in athletics and swimming, for example, allow participation, on the condition that the transperson has not undergone male puberty.
