For sexual abuse of a minor and rape from the moment the woman was of age, a prison sentence of a three-year prison sentence was demanded against a 40-year-old man from Aalden. A year is conditional.
The girl worked in Hardenberg at a fast food restaurant, where the man was Floormanager. At the end of April 2022 a romance was created in the workplace that culminated in a long -term relationship. The girl was just 17 years old when it started, despite the fact that the man is twenty years older, married and just father.
On the eye an equal relationship, because both wanted this. But according to the public prosecutor, the shoe pinches there. Because of his position and age difference, the man has abused his predominance of the girl. He knew he was dealing with a vulnerable child who craved attention and love.
The man read all the reports of her care interviews and was therefore well aware of her psychological situation. That didn’t stop him, the prosecutor said, to continue with much sex for the girl. He only had an eye for his sexual lusts. She didn’t want to lose him, but didn’t want that intense sex either.
“She has grown in this situation and was unable to resist,” said the prosecutor. In June 2024, the now 18-year-old went to the police. She reported, but the interaction continued until December. “She could not get rid of him and therefore not determine her will,” said the public prosecutor. He also finds rape proven.
The care institution where the complainant resides, the man imposed a ban on contact at the end of last year. Both did not stick to that. According to the prosecutor, the declaration and contact ban were red flags for the man. “As an adult he should have known better,” said the prosecutor. He called it shocking that the complainant is still physical nuisance because of sex.
A psychologist reported a personality and sexual disorder to the man. He is therefore insufficiently able to empathize with the other. Reduced attraction has been advised. The treatment is necessary. The public prosecutor took that into account in the punishment requirement.
According to the lawyer, the woman could determine her. She stated that nowhere has it been established that the aforementioned physical discomfort was caused by the sexual relationship with the suspect. Moreover, a prison sentence would disproportionately hit the suspect and his young family.
The court will rule on 26 June.
