The chief magistrate of the Court of First Instance and Instruction number 5 of Avilés, on duty, has issued an order of Provisional prison communicated and without bail for the girl’s grandfather whose mother threw herself yesterday with her in her arms out of a window in the same town. Likewise, she has withdrawn the guardianship of her minor from her mother to give it to her father, who has been released.
Mother and daughter remain from yesterday admitted to ICU from the Hospital Universitario Central de Asturias, the woman in serious but stable condition, and the girl with injuries of varying degrees that do not cause fear for her life.
As confirmed by legal sources to Europa Press, the 65-year-old grandfather is credited with a crime of breach of restraining order and attempted homicide, without prejudice to the fact that said qualification could be modified throughout the investigation and will be transferred immediately to the Asturias Penitentiary Center.
The ex-husband and father of the girl has been released, although he will continue to join the cause, in his case due to injuries. With regard to the custody of the injured minor, the same magistrate has granted him said guardianship, in accordance with article 158 of the Civil Code.

The minor’s grandfather and father were arrested on Wednesday after having a fight during the early hours of the morning in a building on Avenida San Agustín. The reason for the dispute between the two detainees is related to family problems, with the 65-year-old man having a restraining order compared to the 44-year-old.
In turn, the woman’s ex-partner had a restraining order from her between 2016 and 2018, although the affected woman left the Comprehensive Monitoring System in cases of gender violence (VioGén) in 2020 by not registering new complaints.

Due to the injuries, the 65-year-old man was transferred to HUCA and the girl’s father was treated at the San Agustín University Hospital, before his presentation at the National Police Station as detainees.
Hours after this event, the woman -daughter of the first, and ex-partner of the second- he threw himself from a fifth floor with her seven-year-old daughter in her arms at number 38 Avenida de Los Telares, in Avilés.
After taking a ladder to get out of the window, the mother grabbed the girl in her arms and while she was screaming not to throw her, she jumped into the void in a matter of seconds, according to what some witnesses who witnessed the events from a bar nearby told EFE. in front of the building.
Mother and daughter fell on a car who cushioned the blow before they both ended up lying on the sidewalk.

The police have explained that if the woman evolves favorably from the injuries caused, a statement will be taken to clarify what happened. Health sources have confirmed that the mother is seriously ill in the ICU and the minor continues in the pediatric ICU but “out of danger”.
