“While the Foreign Ministry is trying to achieve the release of Gendarme Nahuel Agustín Gallo through diplomatic channels through the relevant international missions, the former ambassador of the Argentine Republic to the Bolivarian Republic of Venezuela Oscar Alberto Laborde —appointed by the then president Alberto Fernandez—, without any type of official authorization, began international efforts by contacting the Gendarme’s family in Argentina, in order to deliver “a letter” to Roosterwith the collaboration of the Government of Venezuela,” denounced the Ministry of National Security to the Argentine Justice.
In the judicial document, the portfolio led by Patricia Bullrich He noted: “The actions of the accused Laborde were not a “humanitarian issue,” as he intends to present it in the media. Quite the contrary, far from defending the human rights of the “disappeared” gendarme, what it does is unduly superimpose itself on the international diplomatic management of the Argentine Republic, in order to justify the openly criminal conduct of the Venezuelan authorities, under the childish pretext of an alleged “irregular entry” that would support the invented suspicion of “espionage”, in addition to endorsing the conditions of detention, disappearance, generating alleged knowledge without having indicated the slightest legal guidelines of its detention, thus endorsing the crime of forced disappearance.”
In the same document, the ministry highlighted: “More than a “humanitarian management”, the behavior of the denounced former ambassador is the complete opposite, since he acted against the interests of the country to support the justification of the forced disappearance of a national. Argentine, arrogating to itself diplomatic powers that can only be exercised by representatives of the Argentine Foreign Ministry. The information we have about the accused Laborde brings him closer to being a collaborator of the Maduro regime.”
“Their actions are only intended to collaborate with the regime that illegally detained Gendarme Gallo, presenting a dictatorial government as “humanitarian,” and our democratic government as “fascist,” presenting the case as an illegal entry intended to intervene in a foreign country through an “espionage service” with a Security Force in an illegitimate manner. This action, attempting to “turn things around”, presenting a truly criminal government as “humanitarian”, arrogating to itself powers of international representation that it clearly no longer possesses, adapts its actions to the criminal category of Treason against the Homeland, just as it does now. We formally denounce it,” the letter concluded.
According to the Security area, Laborde betrayed the country’s interests with the intention of exposing political arguments to harm the Argentine government’s role in protecting the missing officer. In this way, according to what was presented to Justice, the former diplomat tried to manipulate the case by implying that it was an infiltration of a spy into the Venezuelan State.
“The responsibility of the accused is greater, since his duty to defend national interests is greater, due to the hierarchy of the high diplomatic position he held, interests that were deposed in priority to petty political interests, with the sole purpose of discrediting and unduly compromising our country, benefiting a government that has engaged in criminal conduct that compromises it internationally,” maintains the National Government Ministry.
The accusation of Treason to the Homeland It is contemplated in article 119 of the National Constitution and could only be applied to those who took up arms against the Nation, or provided aid to its enemies. According to the ministry headed by Bullrich, the crime must be analyzed and interpreted in its entirety, taking into account article 29 of the CN, since treason consists of disloyalty to the Argentine State as a legally and politically organized entity, without the need to a declared state of war.
