Ministers Hanke Bruins Slot (Internal Affairs and Kingdom Relations) and Kajsa Ollongren (Defence) published a proposal for a temporary law for consultation on Friday 1 April. This temporary law enables the AIVD and MIVD to deploy their existing powers more effectively and more quickly against cyber threats, within a comprehensive surveillance system.
Certain countries such as Russia and China carry out digital attacks on the Netherlands and Dutch interests in order to spy, influence or sabotage. These countries are becoming more and more active with their attacks. This concerns, for example, theft of sensitive information or the sabotaging of vital infrastructure. These kinds of countries use digital infrastructure for their cyber attacks, spread all over the world. They constantly change position. This cyber threat requires the rapid and effective deployment of existing powers and a comprehensive safeguard system that matches the required speed. This is necessary to maintain sufficient insight into the threat emanating from these countries.
The temporary law allows services to be more effective and faster give substance to powers such as investigative mission-oriented interception (bulk interception) and the exploration and penetration of automated networks (hacking).
This requires adequate supervision that is in keeping with the dynamic nature of the cyber approach. The proposal provides for this and regulates a shift in the system of supervision for some powers, from binding prior assessment to binding supervision during and after the exercise of a power.
