ENKIME contradicts Sara Arslan in the dispute over “Take me Späti”: Podcast contract, trademark rights and all background information at a glance.
In the wake of the allegations made by Sara Arslan, host of the podcast “Take me Späti”, against her former management ENKIME, the company is now speaking out via LinkedIn. The statement from the founders of the social media agency states that the creator did not correctly reproduce the processes and contractual agreements described.
Agency statement
Arslan was in two different contracts with the company: a management contract and a podcast contract. ENKIME terminated the management contract after Arslan expressed his wish to terminate both contracts.
The management agency did not terminate the podcast contract because this was only possible with mutual consent. The founders wrote: “We have invested in this project together – on our side with a full production team, budget and infrastructure. The contract protects this investment on both sides with industry-standard clauses.”
Arslan had previously explained in her Instagram story that she had to take care of the editing and marketing of “Take me Späti” herself, even though this was not contractually within her area of responsibility. According to ENKIME, the goal was to only let the joint work end when the podcast contract ended normally.
Dispute over trademark rights
The creator had previously published a clause in her contract that states: “The talent remains the sole owner of all trademark rights (including the podcast name and logo). ENKIME only receives a simple, non-transferable right to use the trademark for the duration and for the purpose of carrying out this contract. Transfer or joint ownership of the trademark is excluded.”
Accordingly, despite separate contracts, it is not legitimate to deny her access to the interview format.
Further allegations and admissions
In her posts, Arslan not only discussed her problems with social media management, but also other allegations from followers who had worked with the company. Among other things, she made allegations of tax evasion, racism, sexism and exploitation. ENKIME rejected these allegations in its LinkedIn statement.
At the same time, the company admits an incident of sexual assault that took place at a company party in 2024. According to his own statement: “The incident was immediately dealt with by those responsible, those affected and management and, among other things, led to a warning to the employee.”
At the same time, the founders admit that they have not dealt with the incident sufficiently: “As managers, we have not managed to offer every employee the space and the discussion climate to address all critical topics.”
They want to do this in the future with experts and equal opportunities officers. The results will be published on the company’s website. “For us, ENKIME is a place where collaboration takes place on equal terms. The basis of this is psychological safety. We are responsible for that,” wrote the founders. Sara Arslan has not yet commented on the agency’s statement.
