Energy labels play an important role in the sale and rental of homes and other buildings. That is why the Ministry of Housing and Spatial Planning is preparing a change decision to further improve the reliability of energy labels. A supervisor will check whether the parties who record, register and check energy labels adhere to the applicable regulations. The Internet consultation On Tuesday, July 15, 2025, the regulator started. Responses to the change proposal are welcome until Tuesday 2 September 2025. This is followed by the final amendment decision.

The energy label is increasing in interest in, among other things, the purchase price, rent and delivery of homes and other buildings. It is therefore important that tenants, buyers, homeowners and others can rely on the quality of the energy label. The public supervisor is appointed to guarantee quality even better.

Tasks and intended supervisor

The Admission Organization Quality Assurance Bouw (TLOKB) is the intended regulator. The regulator checks whether the parties involved in the energy label adhere to the regulations. The regulator also maintains abuses and fraud with energy labels.

The supervisor will receive the following tasks on behalf of the Minister of VRO:

  • The designation of certifying institutions. These provide certificates and check whether the quality system of certificate holders is sufficient.
  • Ensure that certifying institutions work according to the prescribed rules. If they do not comply with the rules, the supervisor can maintain through a public warning or a order subject to a penalty. The regulator can also suspend the certifying institution or withdraw the designation.
  • Ensure that energy labels are only included by energy advisers among certificate holders and according to the rules. If this is not met, it can be enforced via an order subject to a penalty or withdrawing the energy label.

The supervisor will not take over tasks from the parties in the energy label system and use the knowledge and expertise as much as possible within the existing system of certification and accreditation. The regulator only carries out checks and maintains where the existing system has insufficient effect.
