Several employees have failed in their challenge to the election to the supervisory board of Europe’s largest software manufacturer SAP before the Baden-Württemberg State Labor Court.

The chamber in Mannheim rejected the complaint from three employees against the election of four employee representatives and four replacement candidates in March 2024. A spokeswoman for the court said the election was effective.

In their complaint, the employees complained, among other things, of formal violations in the election – and had already failed before the Mannheim Labor Court. According to the spokeswoman, the reasons for the state labor court’s decision will only be published at a later date. The decision is not yet legally binding.

SAP Supervisory Board consists of 18 members

SAP initially did not want to comment on the process. The SAP Supervisory Board has a total of 18 members – nine representatives from the employer side and nine from the employee side.

Among other things, the applicants criticized the fact that election envelopes were accepted by a member of the works council and its chairman. The Mannheim Labor Court had already decided in the first instance that, according to case law, transmission by messenger was generally permissible.

In addition, an election candidate had used her work email signature and the company logo, including her job title, for election advertising. The Mannheim Labor Court had already decided that this did not violate the neutrality requirement.

The court did not address the question of what it would mean if the election of employee representatives were to be declared void.

In after-hours Tradegate trading, SAP shares were temporarily 0.33 percent higher at 225.15 euros.
