Witnesses have given varying statements; the images do not show all the violence against Jimmy, but they do show you making a retreating movement with a knife in your hand. A witness stated that blood later spurted from his leg, the court said about Derzik H.
“You were the only one who was with Jimmy, even though the images do not show you hitting Jimmy, it cannot be otherwise that you were the one who stabbed Jimmy to death. We are talking about very serious violence and possibly as a result of a altercation, you stabbed Jimmy twice. He lost his life, his most precious possession.”
Robberies at festival
The court finds the twenty-year sentence unjustified and decides on a lower sentence; the maximum sentence for manslaughter was fifteen years. In similar cases, eight to twelve years are imposed. The court arrives at the upper limit for manslaughter, “because you are also convicted of theft and violence against others.”
Suspect Arginio E. is sentenced to 18 months in prison: “You were not the one who stabbed, but you were involved in the confrontation with Schepers’ group and the violence against others. You did rob people and threaten people. You had a role in the spiral of violence,” the judge said. Guillermo G. also receives a prison sentence of six months.
