The basic requirements

First of all, it should be clarified whether there is a claim to partial retirement at all. Legally, employees have no general claim to reducing working hours, only a contractually stated agreement in the labor or collective agreement can grant the employee such a claim.

But a corresponding agreement with the employer can also be made afterwards, but the employee is dependent on the benevolence of the manager.

In addition, further basic requirements apply, the employee must have at least the age of 55, as the Federal Ministry of Labor and Social Affairs informed. The models of partial retirement

The relevant working time is calculated from the average agreed time of the past two years.

The second possible variant would be the block model, the employee continues to work fully for 50 percent of partial retirement, but only receives a reduced wage. The other 50 percent are then filled with free time, whereby the reduced wages will continue to be paid out to the regular pension.

What is important, however, is important in both variants of partial retirement that this reduces the pension paid later.
