A notary from the Den Bosch region has been put out of office. On Monday it became clear that the man is no longer allowed to perform his work because he left the settlement of an inheritance for ten years. Among other things, a home, the household effects and a car deteriorate due to his lack of action.
In May 2015 a man died at the age of 72. He had no children and his wife had died. His will stated that the inheritance had to go to two charities.
From that moment on, the notary was responsible for the implementation of that will, but did not do so as it can be expected of him.
No concrete steps
For example, he did not inform heirs about the will. He also had the household effects, car and a home deteriorate. He did not even take action when he heard that the house had been squatted.
Several messages from the ministry and fines of the municipality were no reason for the notary to take action. Nothing caused concrete steps.
Unauthorized
Exactly that is now blamed by the room in front of the notarial profession. These are the disciplinary judges who give an opinion on acting according to the rules that apply to a notary. They think he has violated the most important core value, care.
The notary is said to have put his ‘head in the sand’ for years in order not to have to see his mistakes. Trust is missing from the Chamber and she is afraid that the notary will ‘run away’ again for his responsibility in the future.
For this reason, the heaviest disciplinary measure has been imposed: the dismay from office. This is necessary according to the notarial room to protect social confidence in the notary office.
