The 32-year-old soldier from Helmond who was sharp on August 22, 2023 during an exercise in Havelte is not convicted of this. The Military Chamber in Arnhem does not believe that the man can be blamed for negligence and relies free.

The Public Prosecution Service (OM) demanded a twenty -hour community service for non -following a service instructions on 17 March. The soldier would have insufficiently checked his weapon and the warehouse. The shot was fired during an exercise with loose flodders by students of the Royal Military School. The instructor stopped the exercise because he was suspected that there had been a sharp shot.

No one was injured, but the OM stated earlier that this could have been done. The OM thought the military was responsible for using the sharp pattern and the dangers that it brought with it. The Military Chamber took into account the circumstances in which this happened. Prior to the exercise, the soldier filled his warehouse in the dark and under time pressure with the help of a fast charger.

The man stated that during the exercise the stock of ammunition was redistributed and that he exchanged warehouses with others. At one point the man released a sharp pattern instead of a white, a practice pattern. The military room says it cannot determine whether the sharp pattern was in a warehouse that was filled by the man himself. He did not check it, that is certain.

Then in principle there is a violation of a service regulation. But this is a single mistake, says the military room. That is insufficient to speak of negligent action. “That is why it is not due to his debt that the service regulation was violated,” says the judgment.
