According to a judgment of the European Union, the EU Commission must formally improve the supervisory fees for Facebook, Instagram and TikTok.

In principle, however, the platforms are obliged to pay, which is why the corresponding fee decisions remain effective, the judges said in Luxembourg. A legal remedy at the Court of Justice of the European Union (ECJ) can be filed against the decision.

The EU Commission raises an annual supervisory fee according to the law on digital services (DSA or DSA for short) from providers of so -called very large platforms – which also includes Facebook and Instagram from the Meta Group and Tikok – DSA for short). Among other things, the DSA should ensure that platforms quickly remove illegal content from third parties on their pages. The monitoring of these rules costs the EU Commission money that she wants to get back from the big platform providers. Meta and Tikkok complained against the commission decisions that set the supervisory fee for their services.

Judge: Incorrect basis for determining the fees

The EU Court now complained that the Commission set the supervisory fees on the wrong basis, namely on resolutions. Instead of decisions, a legal act is required at this point, according to the Luxembourg judges. To calculate the fee amount, the Commission determines the average monthly number of active users on the platforms. She was based on data from third -party providers. So far, this methodology has been added to every decision.

After announcing the judgment, the EU Commission commented on the fact that the court confirmed its methodology as solid: “No calculation error, no suspension of payments, no problem with the principle of fee or its amount.” The court’s judgment requires a purely formal correction of the procedure. According to the EU Court, the EU Commission now has twelve months to improve.

Meta and Tikkok welcomed the judgment. The Commission is forcing it to “rethink the unfair methodology to calculate these DSA fees,” said Meta.

In Nasdaq trading, the meta-share at times is 1.01 percent lower at $ 757.99.
