That sentence was confirmed by the Court of Seville on October 20, 2011. El Cuco gave that version of the events during the reconstruction that took place on the floor. He then admitted that he had helped remove Marta’s body from the house. And he accused of participating in those events Samuel Benítez and Carcaño’s brother, Francisco Javier Delgado. Later, he retracted and attributed that confession to the fact that he had under pressure from the police. A defendant has the right to lie in a trial against him, according to Spanish law; but a witness cannot do it, hence El Cuco faces the accusation of perjury.

Rosalía, the mother of El Cucoalso testified as a witness in the trial of the crime of Marta and gave his son an alibi, who he claimed was at home sleeping that night. The woman faces a charge of perjury. An employee of a bar in Seville has denied that she was at home that morning until very late, which denies the version that the woman gave in court.

The trial against El Cuco and his mother for false testimony will be held at the end of May. El Cuco and his mother will give his version on the 26th of that month.
