For attempted manslaughter on his apartment, a 33-year-old man from Emmer-Compascuum was sentenced to 2 years in prison and TBS with compulsory treatment. The 30-year-old victim, among other things, suffered a skull fracture.
The violence took place on July 17, 2023 outside the building where both at that time lived. Before the eyes of shoppers, the victim was kicked and beaten several times at the Jacket Spoel and Runde NZ ran to his head after he was beaten to the ground. Of these are camera images.
This could have ended deadly. There are many vital and vulnerable organs (brain), nerves and bloodstreams in and around the head. By kicking and beating with strength and intensity in this way, this could have ended deadly, the judge judges. Although the victim covered his head with his arms.
The 30-year-old flat resident criticized his roommate. It would cause nuisance. He spoke to him outside the building. The suspect claimed to the judge that he was being attacked first, but the images do not show this. The judge believes that there is no storm. By intervention by bystanders, the suspect was kept away from the victim.
In the beginning the man did not want to cooperate in a psychological examination. That is why he was later observed in the Pieter Baan Center. Experts assume a psychotic disorder and weakness. It is reduced imputable.
The man does not find himself sick. He therefore does not think treatment is necessary. The experts think differently about that. Without a thorough treatment, the chance of recurrence is too great. TBS with compulsory treatment is the only option. The judge agrees.
He did lower the prison sentence. Two weeks ago, the public prosecutor demanded 2.5 years in prison next to the TBS measure. The judge takes more into account the attraction of the suspect. The man has to pay the victim a grief of 4,000 euros.
