The internet consultation on the duty of care surrounding the registration of migrant workers will start from May 22. This obligation applies to lenders, such as employment agencies, secondment companies and payroll companies. An internet consultation is a period during which it is possible to respond to a (legislative) proposal. The responses will be reviewed by the ministry and may lead to adjustments to the proposal. Migrant workers are often incorrectly registered in the Personal Records Database (BRP). Migrant workers who want to stay in the Netherlands for more than 4 months must register as a resident in the municipality where they will live within 5 days of arrival. This is not yet done sufficiently, which means that there is no insight into their home address and there is a good chance that they will miss out on rights. The government is therefore working on a duty of care regarding the registration of all workers in the BRP.
The duty of care consists of a duty to promote and verify. Both were already included in the Allocation of Labor by Intermediaries Act (Waadi). This will come into effect in 2027. With this proposal, these obligations are further detailed in the Allocation of Labor by Intermediaries Decree (Baadi). The duty of care applies to all workers who earn less than 150% of the Statutory Minimum Wage (WML), as they are in the most vulnerable position.
Promotion obligation
The promotion obligation stipulates that the worker must be informed by the lender about various BRP obligations. The Baadi regulates to which parts of the BRP this applies. Furthermore, this must be done in the worker’s preferred language, unless there is another language that he understands and can communicate in.
Obligation to verify
The lender is obliged to check that the worker is registered as a resident in his municipality of residence. In the long term, rules will be introduced about this through the admission system for lenders (Act on the Admission of the Supply of Labor). This happens after the admission system has been fully set up and the capacity of inspection institutions is sufficient.
These obligations implement the coalition agreement and the advice of the SER. Both rules only apply to lenders, not to other entrepreneurs. This was chosen because the largest share of EU migrant workers who are incorrectly registered in the BRP work for them (based on CBS figures, around 70% in 2023).
Broader package
In addition to the measures mentioned, the government is making broader efforts to improve the registration of migrant workers in the BRP. For example, from this summer the government will send emails to migrant workers to remind them of correct registration. In addition, migrant workers can go to physical WorkinNL information points regionally with questions about registration in the BRP. These points are being rolled out across the country and the service is in multiple languages.
