HSV: Public prosecutor’s office files a complaint in the Jatta case, football | 2nd Bundesliga – NDR – Regional

“The reason for this is that the appeal has a chance of success on a preliminary basis,” said Attorney General Jörg Fröhlich on Monday. In addition, “the briefs still in the files must first be evaluated, some of which were included in the court decision but which the public prosecutor’s office never became aware of,” the statement continues.

District court relieved Jatta

A week ago, the district court saw “no sufficient suspicion” against Jatta and declared that there was “no overriding probability that the accused deceived about his identity”. Further investigations against the 23-year-old Gambier were not initiated.

In the letter from the district court, allegations had even been made against the public prosecutor’s office. It was based mainly on unverifiable press reports. Fröhlich rejected this again: “The examination – like the indictment – is carried out exclusively according to legal standards. It is not dependent on newspaper campaigns, opinion polls or comments from third parties.”

Allegations have been around since 2019

The public prosecutor’s office brought charges against Jatta in December 2021. According to the authority, he should actually be Bakary Daffeh, who is two and a half years his senior. The Gambian had been accused of violating the Residence Act in four cases and of indirect false certification in another case.

The first allegations of an alleged false identity of the HSV striker were made in August 2019. At that time, the “Sport Bild” reported that it could be the older Daffeh who received the residence permit in Germany based on false information. Because when he was 17 years old and therefore a minor, Jatta was subject to other criteria for a right to stay.
