Owner Zuidema of the Hotel-Restaurant on the Ommerweg in Zuidwolde believes that the municipality of De Wolden has imposed unjustified penalty payments. He had rented the building to a foundation that made a care-residential location illegally. Zuidema and the municipality were in court in Groningen on Wednesday.
In 2021, a neighbor complained about arson at the hotel-restaurant. Caused by people who lived there under supervision because of a care indication. The rear part of the building was set up as a residential function for healthcare. There is a catering destination on that building on the Ommerweg and such a residential initiative does not fit there. Since the report of the local resident, the hotel-restaurant at the municipality was in sight.
The building has been rented out to Stichting Pollywood since June 2020, which was responsible for the care of people with disabilities. “They arranged the permit with the municipality. After all, it was also their Pakkie An,” said Zuidema. According to the municipality, it had also been on the landlord’s way to check whether the tenant was in a legitimate way. Zuidema had done that too, he said. But he was always told that the municipality was in order.
In May 2023, the landlord received a pre -announcement from the municipality that a violation had been found and would follow an enforcement if that was not terminated. According to Zuidema, the tenant was in violation, not he. In the meantime, the situation remained unchanged, the municipality and the foundation imposed a penalty of 5,000 euros per week with a maximum of 50,000 euros.
Zuidema says it has done everything to get the tenant out of the building. It turned out to be persistent. Last year in July, the judge in summary judge decided that the tenant had to accommodate the residents elsewhere. On November 26 from last year, the Pollywood Foundation eventually went bankrupt. Zuidema remained empty -handed, he told during the session. The building has been empty since last year.
The owner has neatly paid the penalty payments. He wants the judge to decide whether the penalty payments are rightly imposed. If the judge, like him, thinks this is wrong, he can get the money back. The judge takes six weeks to rule.
