Government compensates local residents for noise nuisance | News item

Residents living near Schiphol in the municipalities of Uithoorn, Haarlemmermeer, Aalsmeer and Amstelveen are eligible for compensation for noise nuisance. It concerns people who, in the period from November 2017 to October 2019, lived in the vicinity of an enforcement point of which the limit value for noise was exceeded. The Ministry of Infrastructure and Water Management announced this on Thursday.

There are enforcement points around Schiphol with limit values ​​for the maximum amount of noise that may be generated. Compliance with the limit values ​​is assessed on the basis of these enforcement points. But because in recent years flights have already been carried out according to new rules that have not yet been officially laid down (anticipatory enforcement), the ILT has not enforced any exceedance of those limit values.

In 2020, 9 local residents indicated that they had suffered damage due to anticipatory enforcement and submitted requests for compensation. An independent committee led by mr. dr. Onno te Rijdt, commissioned by the Ministry of Infrastructure and Water Management, issued an advice on the requests. The committee ruled that anticipatory enforcement does indeed lead to a loss of enjoyment of living.

The Ministry has adopted the advice and has had it investigated how many other local residents are faced with similar circumstances. It concerns about 4600 addresses. In the week of April 24, the residents of the relevant addresses will receive a letter from the Ministry with information about the compensation for disadvantages and the application procedure.

From May 1 to July 31, 2023, they can submit an application for compensation. The aim is to assess all applications within 8 weeks after the closing date. That means most people will receive their compensation before the end of the year.

The amount of the loss compensation depends on the extent of the excess and the WOZ value of the address. This has been calculated for all addresses that qualify for compensation. The majority of the amounts are expected to fall in a bandwidth between € 50 and 2,200.
