District court: proceedings would have resulted in acquittal

The Hamburg public prosecutor’s office brought charges against the Gambier in December last year. According to the authority, he should actually be Bakary Daffeh, who is two and a half years his senior. Jatta had been accused of violating the Residence Act in four cases and of indirect false certification in another case.

Since, according to the district court, there is no reliable information on the date of birth attributed to Bakary Daffeh and the passport, which can be regarded as genuine, as well as the birth certificate of the accused strongly support his pleadings, the court is convinced that “it is highly unlikely that an incorrect date of birth was used and the accused would be acquitted of the allegations due to lack of evidence”.

No further investigation

The first allegations of a possible false identity of the attacker were made in August 2019. “There is no suspicion and no reason for further investigations,” said Bliwier now: “That has been determined.” The public prosecutor’s office can still appeal against the court’s decision.
