The adopted private member’s bill on Fixed Rental Contracts Act regulates that temporary rental contracts are abolished. This provides more security for tenants. For specific target groups – such as students and urgent housing seekers – a temporary contract can offer a solution. These exceptions are included in an Order in Council (AMvB) that will be sent to both Houses today. Both the law and the AMvB are expected to come into effect on July 1, 2024.

Abolition of temporary contracts

Temporary rental contracts have been permitted since 2015. A temporary rental contract for a fixed period ends automatically after the agreed period. The Senate and House of Representatives want to use the initiative law to ensure that temporary rental contracts are abolished. Permanent contracts will then become the norm again.

Exceptions to temporary contracts for specific target groups

The House of Representatives has asked Minister De Jonge of the Interior and Kingdom Relations to make an exception for target groups for which temporary rental contracts remain necessary. This means that temporary rental, for a period of two years or less, remains possible in some situations.

Groups to whom the exception will apply

  1. Students
  2. Tenants who temporarily live elsewhere due to urgent work or renovation of their home
  3. Urgent home seekers
  4. Tenants with whom the landlord enters into a second chance contract: tenant whose previous rental contract has been terminated, for example because it caused serious nuisance
  5. Orphans and surviving relatives
  6. Divorced parents
  7. Tenants who work on the Wadden Islands
  8. Permit holders (status holders) who come directly from a COA reception location

New law expected to come into effect on July 1, 2024

The AMvB has been submitted to the House of Representatives and the Senate for consideration. The aim is for the Fixed Rental Contracts Act and the associated Order in Council to come into effect on July 1, 2024.
