Good news for Fredi Bobic: The 53-year-old has achieved success against his ex-club Hertha. But the procedure could go on.
In the legal dispute with ex-managing director Fredi Bobic has second division club Hertha BSC have to suffer a defeat in front of the Berlin district court. The judges gave the 53-year-old right in a documentary process by means of a reserved judgment-Bobic has thus obtained a preliminary enforcement title.
If he enforces this, Hertha would have to pay around 3.35 million euros gross to the former managing director. In addition, there are interest that may increase the total to over four million euros. The club must also cover the procedural costs. However, post -proceedings are still possible.
Fredi Bobic was satisfied after the decision. “I am very happy that clear rights are spoken,” he said. Now he hopes for an end to the procedure: “I wish that it is over now. The Hertha is responsible for whether it is over now.”
Bobic enforced the title, the Berliners must deposit 110 percent of the sum he is entitled to as a security deposit in the court. After the next legal defeat, the Hertha can also choose to refrain from post -proceedings and pay Bobic the money directly. The post -proceedings would be conducted as a normal civil process in which all evidence is permitted.
Specifically, Bobic, who had to go to the Bundesliga club at the time in January 2023, insisted on salary for February to April 2023 and a contractually defined severance payment. In the procedure, he actually wanted to force the enforcement title as quickly as possible, with which he could ask the clammy Hertha to pay.
But the procedure was two and a half years. Again and again, among other things, bias from the Hertha side caused a delay. In May of this year, the court had proposed an agreement on a comparison of 3.2 million euros at the request of both sides. According to Bobic, Hertha then rejected the offer.
The 53-year-old had sued in two procedures after his ordinary and extraordinary termination. In the second procedure, the district court of Bobic’s lawsuit had upheld the extraordinary termination. However, Hertha went to appeal. There is still no new appointment here. Bobic is now a football director at the Legia Warsaw Polish Club.
