The Dutchman had turned to the court (ECHRM) because of a criminal proceedings that had been established against him in Slovakia, Media reported in the Eastern European country. The man was taken into custody in October 2020 after he was handed over by his home country.

The Dutchman complained about the duration and the alleged arbitrariness of his prisoner. He mentioned a lack of impartiality of the court that decided on his detention and the violation of the suspicion of innocence. The Dutchman had been in custody for two years and three months.

No regular stay the Netherlands

The Court noted that the National Court had justified the detention of the suspect correctly. The man does not have a regular stay in the Netherlands and in Slovakia, so there would be a flight hazard.

The judges had also taken into account the organized nature of the criminal activities of the man, which is suspected of the smuggling of large quantities of drugs via Slovakia to various other countries.

Regarding the issue of the alleged impartiality of the court and the suspicion of innocence, the ECtHR went along with the arguments of the Slovak authorities. His conclusion was that no circumstances had been demonstrated that justified the claimant’s concern about the impartiality of the judge.

The man will be on trial soon and then hear if, and how long, he will stay behind the Slovak bars.
